The authentication of foreign-issued documents is an important time-consuming step when preparing a medical device regulatory submission in Mexico. Documents issued by foreign health authorities, certification bodies, or manufacturers may need to be authenticated before they can be submitted to COFEPRIS. This process allows the authority to verify that a document is genuine, has not been altered, and comes from the organization or individual identified as its issuer.<\/span>\u00a0<\/span><\/p>\n

Until recently, companies\u00a0generally relied\u00a0on two established routes to authenticate foreign documents: apostille and consular legalization. However, as health authorities and certification bodies increasingly issue electronically verifiable documents, COFEPRIS has shown greater flexibility in accepting digital verification as an alternative in\u00a0appropriate cases.<\/span>\u00a0<\/span><\/p>\n

This development can help manufacturers simplify their regulatory processes, provided that the authenticity of the electronic document can be properly verified.<\/span>\u00a0<\/span><\/p>\n

Traditional Authentication Routes for Foreign Documents<\/span><\/b>\u00a0<\/span><\/h3>\n

As explained in our\u00a0previous\u00a0article about\u00a0<\/span>apostilled documents in the medical device industry<\/span><\/a>, the purpose of document authentication is to confirm the authenticity of a legal document and, when applicable, the signature or seal of the issuing official.\u00a0<\/span>\u00a0<\/span><\/p>\n

Traditionally, foreign documents have been authenticated through one of two routes:<\/span>\u00a0<\/span><\/p>\n

  1. Apostille:\u00a0Used when the country issuing the document and the country where it will be\u00a0submitted\u00a0are parties to the Hague Apostille Convention.<\/span>\u00a0<\/span><\/li>\n
  2. Consular legalization:\u00a0Used when the applicable countries are not covered by the Hague Apostille Convention.<\/span>\u00a0<\/span><\/li>\n<\/ol>\n

    Apostille is the simpler authentication route because it replaces a longer chain of certifications. Consular legalization, by comparison, may involve several authorities and the embassy or consulate of the country where the document will be used.\u00a0<\/span>\u00a0<\/span><\/p>\n

    Health authorities and certification bodies are increasingly replacing paper certificates with digitally issued documents.<\/span>\u00a0<\/span><\/p>\n
